Understanding Section 498A IPC and Domestic Violence:

Section 498A of the Indian Penal Code addresses cruelty towards a married woman, encompassing both mental and physical abuse by her husband or his relatives . This includes both mental and physical cruelty, and cases related to 498A are often emotionally charged and legally intricate, requiring nuanced legal expertise. Domestic violence cases encompass a broader spectrum, involving abuse or violence within a domestic setting.

Key Features of Section 498A IPC:

Section 85 & 86 in the Bharatiya Nyay Sanhita (BNS) 2023 : New Criminal Code for a New India

The Bharatiya Nyay Sanhita (BNS) is overhaul of India's criminal justice system. It aims to modernize and consolidate existing laws, with a focus on gender neutrality, victim-centric justice, and fairness. Among the most important changes in the BNS is the introduction of Sections 85 and 86, which have replaced Section 498A IPC with effect from 1st July 2024.

Section 85 and Section 86 in the BNS reflect a more inclusive and balanced approach to addressing domestic violence, cruelty, and abuse within families. These sections aim to provide similar protection to women, as was provided under Section 498A and incorporating a broader understanding of domestic cruelty. Under BNS 2023 sections 85 & 86 have been put under the Head : Husband or relative of husband of a woman subjecting her to cruelty

Section 85 of BNS :  Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be punished with imprisonment for a term which may extend to three years and shall also be liable to fine.

Section 86 of BNS :  For the purposes of section 85, “cruelty” means— (a) any willful conduct which is of such a nature as is likely to drive the woman to commit suicide or to cause grave injury or danger to life, limb or health (whether mental or physical) of the woman; or (b) harassment of the woman where such harassment is with a view to coercing her or any person related to her to meet any unlawful demand for any property or valuable security or is on account of failure by her or any person related to her to meet such demand.

For the purpose of applicability of above provisions :

(a) The woman must be married;

(b) She must be subjected to cruelty or harassment; and

(c) Such cruelty or harassment must have been shown either by husband of the woman or by the relative of her husband.

While the BNS is a step forward, concerns remain about its potential for misuse. The Supreme Court has urged the government to consider making necessary changes to Sections 85 and 86 to avoid frivolous complaints.
